Federal Law requires dealers in Florida affixing the buyer’s guide sticker on the window of each used car that they are selling. Dealers beware the buyer’s guide must be visible at first sight, both the front and the back. The law describes that the buyer’s guide must be prominently and conspicuously attached to the window. Also the name and contact of the person to call must be listed. “The sticker” is to inform the car buyer if the car comes with a warranty or not. If the car is sold “As Is”, means no warranty, do not make oral promises if you cannot enforce them in writing.
If the deal was conducted in Spanish, the dealership should provide a Spanish version of the Buyer’s guide.
Also, an implied warranty is present when a dealership cannot affirmatively disclaim warranties in writing. This is just a warranty that the car can do what it is supposed to do. Another way to keep you safe is avoiding falling into “fitness for a particular use”. For example, saying that the car they are about to purchase drives great under awful weather conditions like mud or dirt roads, or the car is capable of hauling a trailer.
Last, but not least, a good title. Perhaps, this is one of the most important things when selling a car, as it may help to keep you away from troubles. Salvage titles, rebuilt titles and floods titles are not to be overseen.
